What is a Phase I Environmental Assessment?
The purpose of a Phase I ESA is to meet the All Appropriate Inquiry (AAI) requirements under CERCLA to protect purchasers of commercial property. Formerly, CERCLA law held new owners of commercial properties liable for environmental issues and did not protect new purchasers of commercial property. The properly conducted Phase I ESA provides for the landowner's defense under CERCLA.
The EPA defined AAI as “the process of evaluating a property for potential environmental contamination and assessing potential liability for contamination present at the property” in order to demonstrate that a person ‘did not know and had no reason to know’ prior to acquiring a property that any hazardous substance that is the subject of a release or threatened release was disposed of, on, in, or at the property.
For how long is a Phase I Environmental Assessment valid?
Phase I ESAs are valid for 6 months and may be updated within one year of the report date. After one year, to meet the AAI rule, a new Phase I ESA is required.
